Ron
Paul for President?
Libertarian
congressman Ron Paul (R-TX) has created an exploratory committee
to consider a run in 2008 for the U.S. presidency.
In 1988 Paul was the Libertarian Party candidate for president and
received more than 400,000 votes. This time he will run as a Republican.
Kent Snyder, chairman of Paul's exploratory committee, told the
press that if Paul runs, it will be a serious attempt to win the
White House, not just to raise attention to issues.
"There's no question that it's an uphill battle, and that Dr.
Paul is an underdog," Snyder said. "But there was also
a time when Jimmy Carter was not well known at all, when Bill Clinton
was not well known at all.
"This is going to be a grassroots American campaign,"
Snyder said. "For us, it's either going to happen at the grassroots
level or it's not."
Paul has served nine terms in Congress. He has long been a hero
to libertarians and other fans of limited government. And in recent
years, as both liberal and conservative policies and politicians
have failed, Paul's popularity has risen.
Paul's appeal cuts across the political spectrum. Those on the left
admire his ironclad commitment to civil liberties and his advocacy
of a foreign policy of peaceful non-intervention in the internal
affairs of other nations.
Free-market conservatives admire his fiscal conservativism. John
Berthoud, president of the National Taxpayers Union, an organization
that promotes lower taxes, has said, "Ron Paul has always proven
himself to be a leader in the fight for taxpayer rights and fiscal
responsibility... No one can match his record on behalf of taxpayers."
Paul has emerged as one of the strongest critics of the Iraq war.
He was one of only a handful of Republicans to vote in 2002 against
giving President Bush the authority to use military force in Iraq,
contending that only Congress had the power to declare war. He has
delivered blistering anti-war speeches on the floor of Congress.
As the war has grown increasingly unpopular, Paul's principled stance
has come to be appreciated and admired.
As the popular liberal blog Wonkette puts it, in a post entitled
"Save America! Ron Paul for President!": "Paul is
a libertarian Republican who constantly enrages the GOP because
he actually believes in a small federal government and sound fiscal
policies. He's ... anti-drug laws, anti-police state, anti-Patriot
Act and anti-anything that's not authorized by the Constitution."
Paul has staked out bold, consistent libertarian positions. He has
introduced legislation to abolish the federal income tax; is a staunch
defender of gun rights; opposes the War on Drugs; is a champion
of sound money; and in general has been a wonderfully consistent
defender of the libertarian ideals of personal and economic liberty.
Paul says that he votes only for measures specifically authorized
by the Constitution. This means, of course, that he votes against
almost all proposals for government spending, initiatives, or taxes,
whether Republican or Democrat. That has earned the former obstetrician
the nickname "Dr. No." A fairer nickname would be "Dr.
Constitution" or "Dr. Liberty." Or perhaps even better,
as his wife suggests, "Dr. Know."
As a non-profit educational organization, the Advocates does not
endorse candidates. However, Congressman Paul has long been a friend
of the Advocates, and we in turn have long been great admirers of
Congressman Paul. We can only welcome the wonderful educational
effect of a presidential campaign by the man we have called many
times "the greatest congressman since the days of the Founding
Fathers."

Bush
Claims The Right To Open Your Mail
Despite
the Fourth Amendment, and despite federal law, President Bush says
he has the right to open the mail of U.S. citizens without a search
warrant.
On December 20 Bush attached a "signing statement" to
a postal reform bill. (As we have reported in past issues, Bush
has issued more than 750 "signing statements" to bills
passed by Congress, in which he sometimes declares his intention
to ignore parts of a law even as he signs it into law.)
This latest signing statement declares -- without a shred of legal
backing -- that the president has the power to order people's mail
opened for loosely defined security reasons.
This asserted power blatantly violates U.S. law, which was passed
precisely to prevent what Bush claims he can do. Indeed, Bush's
assertion actually violates the wording of the very bill he attached
it to. That bill, the Postal Accountability and Enhancement Act,
explicitly restates that the government cannot search first-class
mail without a search warrant.
However, as a New York Times editorial pointed out, claiming
powers beyond the law is nothing new for Bush: "[T]he law is
also clear on the need to obtain a warrant before intercepting Americans'
telephone calls and email. Mr. Bush began openly defying that law
after Sept. 11, 2001, authorizing the National Security Agency to
eavesdrop without a court order on calls and email between the United
States and other countries."
Bush's 750 signing statements total far more than all past presidents
combined. While many are benign, in some he declares that he is
exempt from the law he is signing.
Bush's freewheeling abuse of the signing statement process has created
a genuine Constitutional crisis. If he can declare himself exempt
from the very laws he signs, why bother to pass bills designed to
restrain presidential powers? Why even have a Congress at all?
As the Sacramento Bee newspaper put it: "The Constitution
says the president 'shall take care that the laws be faithfully
executed.' In our system of government, the president cannot selectively
ignore laws he doesn't like. If Bush doesn't like a law passed by
Congress, he should veto it.
"Clearly, our system of separation of powers is in doubt as
the president claims unilateral powers to do whatever he wants.
More than 200 years after Americans rejected the tyrannical acts
of King George III, we've got another George with kingly pretensions
that need to be checked."

The
world lost one of its most eccentrically brilliant writers, philosophers,
pranksters and dangerous minds on January 11, 2007, when the great
libertarian writer Robert Anton Wilson passed away.
Wilson wrote more than two dozen remarkable books of subversive
and provocative fiction and non-fiction. He is perhaps best known
for his 1975 conspiracy-mocking satirical masterpiece Illuminatus!
-- co-authored with fellow libertarian Robert Shea -- which
introduced radical libertarian ideas to a huge audience of readers
(including your editor).
Brian Doherty of Reason magazine notes that Wilson "was
a grand recruiter for libertarianism, both through Illuminatus!
and his series of optimistic, futuristic, epistemologically
anarchistic essays and nonfiction works that stress the glories
of no human limits, physical, spiritual, or political."
Wilson wrote prolifically on innumerable topics, including (to name
just a few): conspiracy theories, Sufism, futurism, Zen Buddhism,
Aleister Crowley, G.I. Gurdjieff, Timothy Leary, UFOs, Forteanism,
the War on Drugs, quantum physics... His books opened eyes, raised
innumerable questions, and never failed to provoke laughter and
astonishment.
Wilson's influence permeates our culture today, often in ways most
people never realize. As Reason's Jesse Walker wrote a
few years ago: "Robert Anton Wilson is the unacknowledged elephant
in our cultural living room: a direct and indirect influence on
popular books, movies, TV shows, music, games, comics, and commentary."
Wilson was not a doctrinaire libertarian -- his trademark skepticism
would not allow that. But he was steadfastly libertarian on most
important issues, and said libertarianism was the political philosophy
he felt most comfortable with.
"Liberty can survive only as long as most people distrust their
government, and falls into decline and the 'sickness unto death'
whenever the people trust a government too damn much." -- Robert

For... Walking?
In Atlanta,
Georgia, police can arrest you for just walking down the sidewalk.
Or hanging out.
It happens mostly in poor black neighborhoods. Which is why some
call this offence "walking while black."
The charge is "DC-6" -- Disorderly Conduct in a Known
Drug Area. Most people think "disorderly conduct" involves,
well, acting disorderly.
But that's not the case.
According to the DC-6 ordinance: "It shall be unlawful for
any person [to] ... be in or about any place where gaming or the
illegal sale or possession of alcoholic beverages or narcotics or
dangerous drugs is practiced, allowed or tolerated[.]"
In other words, a person can be arrested simply for being in what
police consider a "known drug area" -- even if he or she
is just walking down the street or chatting with a neighbor.
And what's a "known drug area?" Well, that's another problem.
It's apparently anywhere police say it is, according to a police
employee interviewed by the Atlanta newspaper Creative Loafing.
The employee said there is no official list of "known drug
areas." Instead, it's "all up to the officer's discretion."
"It's one of those catch-all laws that police use when they
can't think of any other charge," says American Civil Liberties
Union Legal Director Gerry Weber. "It's a street-clearing device."
DC-6 arrests are far from rare. In fact, according to Creative
Loafing, it is the most frequent non-traffic offense cited
by Atlanta police. Over 7,500 DC-6 arrests -- about 22 per day --
were made in 2006.
Weber says the ACLU is seeking the right case for a legal challenge.
With 22 arrests per day, that shouldn't be hard.
Walking unmolested down the street. Another freedom lost to the
Drug War?

Gresham's
Law of Communication -- and How to Reverse It

"Bad
money drives good money out of circulation," says Gresham's
Law of Money, "when there are legal tender laws."
Imagine that you have two coins, each with a face value of $10.
One has ten dollars worth of silver or gold in it. Good money. The
other is made from cheap metals and has, perhaps, ten cents' worth
of metal in it. Bad money.
Imagine that the government legally requires you and everyone else
to accept both coins at their face value. Ten dollars. You can spend
either coin for ten dollars worth of goods or services. It might
seem like no big deal.
But there's a wrinkle. The government starts coining billions of
dollars worth of the cheap metal money. Increasing the money supply.
Inflating the currency.
The purchasing power of money falls. You and everyone else expect
the government to print and coin more money every year. And the
next. And the next.
Imagine that you receive $20 for work. Two coins. One with gold
or silver in it. The other without. Which coin do you spend? And
which do you keep?
Right! You spend the bad money. And save the good money. And so
does every other sensible person.
That's Gresham's Law.
Gresham's Law only operates when there are legal tender laws. When
government decrees that "this note is legal tender for all
debts, public and private" -- and legally requires people to
accept it.
Gresham's Law of Communication
Gresham's Law of Communication says, "Bad communication drives
out good -- when both are equally acceptable."
Rude, insulting, profane, and inflammatory discussions drive out
those which are courteous and respectful. Shouting and name-calling
discussions drive out those that are conversational and reasonable.
Talking-without-listening discussions drive out those that are open-minded
and thoughtful.
We can see it on political talk shows. Hear it on talk radio. Read
it on the Internet.
We spend our vices. And hoard our virtues. Because bad communication
drives out good.
But there's a way to reverse Gresham's Law of Communication.
There is no"legal tender law" of communication.
You do not have to accept bad communication. You do not
have to accept profanity, rudeness, shouting, inflammatory language,
insults or any other kind of communications you find offensive.
Conversations and discussions are based on mutual consent. You can
negotiate the terms and conditions of your communications.
How?
Tell people what you want -- and ask if they will do it.
* "John, I really want to talk with you
about this, but when you raise your voice, when you call me names,
I feel insulted and talked down to. Are you willing to lower your
voice and stop name-calling -- so I can carefully consider your
arguments and evidence?"
* "Janet, I know you're passionate about
global warming, and I respect that. But when you call people who
disagree 'deniers,' you are putting them in the same category
as Holocaust deniers. Your language is designed to stigmatize
and silence them. Are you willing to stop using the word 'denier,'
and show us your evidence? Will you do that?"
* "Tom, I know you feel very strongly about
the Iraq War. I want to hear you out. But when you condemn the
character and motives of those who disagree with you, when you
loudly insult and revile them, I find it almost impossible to
listen to your actual arguments and evidence. I need you to stop
insulting people who disagree with you. And I need you to calmly
lay out your thinking. Will you do that for me?"
You can explain what kind of language and behavior is and is not
acceptable to you. Ask the other person what kind of language and
behavior is and is not acceptable to her. You can negotiate. Work
it out together.
What if they refuse to converse in a way that's acceptable to you?
What if they continue to engage in offensive language and behavior?
Tell them what is unacceptable. Tell them why. Walk away.
Requesting, negotiation, and walking away are three powerful tools
for creating good communications. For building courteous and civil
conversations.
You can use them with your family, friends, and co-workers. And
with casual acquaintances and strangers.
And you will begin to make a difference. As will others who do likewise.
From such small beginnings, we can set in motion a social trend
of courtesy and cooperation.
You and I and others can reverse Gresham's Law of Communication.

How
can a free market protect consumers against business abuses?
QUESTION: "In a libertarian free-market society, how
would citizens prevent huge businesses from joining together and
imposing their will on the people?"
MY
SHORT ANSWER: Today's mega-businesses lobby for government
regulations to drive their smaller competitors out of business.
In a libertarian society, these regulations wouldn't exist. Consequently,
a business could grow big only if it gave consumers better quality
service at a better price than its competitors.
Turn-of-the-century oil magnate John D. Rockefeller failed to create
a monopoly by getting his competitors to charge uniform, high prices,
because one business would always be tempted to profit by underselling
the rest of the cartel. He found he could only gain a 90% market
share by underselling everyone else. When he tried to raise prices,
competitors sprang up to undersell him!
Consequently, by the time anti-trust legislation broke up Standard
Oil, it refined only 64% of U.S. oil. Consumers also had other options
for heating, since innovation created new forms of energy (e.g.,
natural gas). Rockefeller couldn't keep his monopoly and exploit
consumers, because the free market protects consumers with competition
and innovation.
When government drives competitors and innovators out of business
with regulations, or an outright grant of monopoly (e.g., utilities),
consumers are no longer "king." Instead, the monopolies,
like the former AT&T, overcharge consumers so that their stockholders
profit, as they did even during the Great Depression.
Ironically, most people believe that government protects them from
monopoly exploitation. Just the opposite is true!

Simple Step To A More Productive Meeting

You'll
probably laugh at this tip, because it seems so self-evident. But
it's so important, and so frequently overlooked, I'm going to offer
it anyway.
It's simple. When you are at a libertarian or other liberty-oriented
meeting, make sure that you, or someone with the sponsoring organization,
get the names and contact information of those who attend.
I have been to countless libertarian-oriented meetings. And time
after time, I have seen this simple rule ignored.
So many times I've heard someone ask, "Who was that interesting
new person?" And the answer is...no one knows. Because no one
bothered to get their name, email address, mailing address, and/or
phone number. And the person vanishes into the night, perhaps never
to be seen again.
What a loss! That person might just be a possible libertarian candidate,
contributor, speaker, teacher, writer, activist, voter -- if there
was a way to contact him and invite him to the next meeting or activity.
If your organization doesn't do this at every meeting, find someone
who will. Or appoint yourself. Ideally, the person who collects
names will also give a warm, friendly greeting to newcomers. And
distribute name tags and introductory literature.
But...get those names and that contact information! Activists for
liberty are too rare, too precious, to let even one slip by.
