Dear friends,

The "Hammer of Truth" blog (http://hammeroftruth.com) is a free-flowing forum for discussion of libertarian topics.

Last week, one post attracted my attention. It was by Stephen VanDyke, and it was about the World's Smallest Political Quiz.

Stephen VanDyke is Internet Strategist for the Ohio gubernatorial campaign of Libertarian Party candidate William Pierce. Pierce is running an impressive campaign that is getting significant media attention. And one of the tools the Pierce campaign is using is the Quiz. The excellent Web site of the campaign links to the Quiz. The Quiz is also featured on the back of Pierce's campaign cards. This is not only eye-catching and makes his cards a "keeper" for people; it means each card handed out performs a valuable educational/outreach function that will pay off in the future for years to come.

With that background, let me share excerpts from Stephen's post with you.

Wanna Take A Personality Test?

"Last night I went out drinking with some friends here in West Cleveland, and I took a few of the Pierce for Ohio Governor promotional cards with me. On one side is the World's Smallest Political Quiz, and on the other is some, well... marketing propaganda for the Pierce campaign. I had a stack of about 40 with me when I left the house, I came back with zero.

"The best part, I didn't have to push it but on a few people, and they suddenly became viral marketers. All around the bar where we were, people were suddenly lighting up over this novel little Quiz (and even though it's obviously skewed, the general consensus was that the issues raised were timely if anything).

"The crowning moment though, was when I went back to the bar counter at one point to get more drinks for our group, and... here's what someone asked me: "Hey have you taken this Quiz? This is [expletive deleted] great!"

"I've said it before and I'll say it again: liberty is already pop-culture, forget left and right... We need to brand ourselves as the party that stands up and says: 'You suck, government.'"

"I did something similar at work before the 2004 election. I handed a few [Quizzes] out and before I knew it, everyone was talking about it and wanting to take the Quiz. Most had never heard of 'libertarian' -- which was great."

Now a few observations:

1. I love the article. Thanks, Stephen! However, I respectfully disagree that the Quiz is "obviously skewed." To the contrary. We've done our best to create a Quiz that, while short, gives accurate, useful and honest political insights. That's one reason why it's in textbooks and hundreds of classrooms, and has been praised by the Washington Post, USA Today, the London Times, and many, many others.

2. The Quiz works! Stephen hit on one of the great strengths of the Quiz -- it sets off viral marketing. Like magic, it opens people's eyes to a new way of looking at the political spectrum. And then, those newly-enlightened want to share it with others. It's irresistible and fun! I've seen this over and over again. The Quiz is an incredible, tested and proven tool that needs to be used by many more libertarians.

3. The Quiz is so eye-catching, so fun, so enlightening that it makes a great addition to any political campaign. We love to see candidates and organizations link their Web sites to the Quiz (as the national Libertarian Party, and many state and local LPs, do) and we love to see the Quiz used in campaign literature.

One Year After Kelo: Eminent Domain Abuse Skyrocketing

Friday, June 23, marks the one-year anniversary of the Supreme Court's notorious Kelo v. City of New London decision. That decision, one of the most denounced in the Court's history, allows local governments to seize homes and businesses through eminent domain and give that property to private businesses.

In Kelo, the Supreme Court ruled that the mere possibility that a different use of the property might generate more taxes or jobs was sufficient reason for seizure.

One year later, has eminent domain abuse gotten worse, as some critics predicted?

Yes, says the libertarian Institute for Justice, which fought the Kelo case all the way to the Supreme Court. Much worse.

Last year more than 5,700 homes, businesses, churches, and other properties nationwide were threatened or seized with eminent domain for private development. And that may be only a fraction of the cases; statistics are very difficult to come by.

This number is an astonishing increase. It is more than half of the total number of known cases for fully five years prior to the Supreme Court ruling. Clearly, Kelo has been a green light for such seizures.

According to a new report from the Institute for Justice, "The Kelo decision emboldened officials and developers, who started new projects, moved existing ones forward, and, especially, threatened and filed condemnation actions. ...[C]ities are pushing out motels for commercial development and replacing small businesses with upscale hotels. Homes are being replaced by shopping malls, but the stronger trend has been the replacement of middle-class residences for other, more upscale ones. Agricultural land has been taken for still more retail development."

One encouraging sign is that many states, responding to the demands of outraged citizens, have passed laws limiting or prohibiting Kelo-type eminent domain. Twenty-five states (out of the 45 that had legislative sessions this year) have enacted legislation curbing the abuse of eminent domain. Three more states passed bills now waiting signatures by governors.

Some of the bills offer less protection than others, and many are flawed in some ways, but this is a remarkable response in so short a time.

Still, that leaves huge numbers of Americans utterly unprotected from the evil alliance of greedy businesses and big government. Notes the Institute for Justice: "That's all the more reason why Congress needs to pass legislation preventing the use of federal economic development funds to those state and local agencies that use eminent domain for private commercial development."

Currently, a bill that would do just that -- the Private Property Rights Protection Act of 2005 (HR 4128) -- is stalled in the U.S. Senate. It passed the House by a vote of 376-38 in November 2005.

The Institute for Justice has formed an organization, The Castle Coalition, to inform the public and fight for reform on this issue. The Castle Coalition defines itself as "a nationwide network of home and small business owners that uses activism to fight the private-to-private transfer of property by the government through the use of its eminent domain power."

Blogging Superstar is a Libertarian

Glenn Reynolds
One of the most popular and influential bloggers in the world is a libertarian. He's Glenn Reynolds, author of the renowned Instapundit.com blog -- with an audience of millions.

In a 2003 interview Reynolds was identified as a self-described "techno-libertarian."
At Instapundit.com he's written that his "chief interest is in the intersection between advanced technologies and individual liberty."

And recently he declared: "As a libertarian myself, I'd love to see the nation run under small-government principles."

Reynolds takes libertarian-style positions on a wide range of issues, sometimes voicing views controversial among libertarians. In the U.K.'s The Guardian newspaper, he wrote: "I support gay marriage, drug legalization and abortion rights. I am in favor of stem-cell research, and against prayer in school... I also oppose gun control." He wrote that he favors the "traditional strain of American belief that government should mind its own business, and that what goes on in our bedrooms, or our closets, is none of its business." Reynolds' enthusiastic support of the U.S. invasion of Iraq -- which he justifies as part of "a war on fundamentalist Islamist terror" -- has angered many anti-war libertarians.

There's no denying that Reynolds is one of the genuine superstars of the blogosphere.

As of early 2006, Instapundit.com was the 12th most popular blog in the world, as measured by unique links in the previous six months. On a good day, Reynolds' blog can get up to a half-million page views, according to the Wall Street Journal.

Why is his blog so incredibly popular? "Beats me," Reynolds shrugs. "Other than emailing a few journalist-types early on, I've done nothing to promote Instapundit; it's all been a function of links and word-of-mouth. Well, word-of-email, anyway. It's just the magic of the Internet."

Reynolds says he began writing Instapundit.com in August 2001 because "It beats yelling at the TV." He writes about "anything that interests me," he says, and posts dozens of times a day.

Reynolds is a law professor at the University of Tennessee. He is the author of several books, most recently An Army of Davids: How Markets and Technology Empower Ordinary People to Beat Big Media, Big Government, and Other Goliaths. The book argues that "small is the new big," and that new technologies -- the Internet, medical advances, digital video cameras, nanotechnology -- are giving unprecedented power to individuals, while siphoning power from big-government bureaucrats and large organizations. James L. Merriner of the Chicago Sun-Times called An Army of Davids one of "the most important books of the year."

And in his spare time... he writes another blog! GlennReynolds.com is hosted by MSNBC and features "longer, more op-edish stuff."

Controversial even among his fellow libertarians, Glenn Reynolds is a trailblazer in a revolutionary new form of journalism and political activism that could well change the world. Let's hope more libertarian bloggers meet with similar success.

Federal Workers Paid Double Private-Sector Workers

The average civilian federal worker receives nearly twice the pay of the average private-sector worker.

Further, that gap is widening. Increases in federal pay and benefits far outpace those in the private sector.

So says a new study by the Cato Institute.

Indeed, according to Chris Edwards, author of the study: "The federal civilian workforce has become an elite island of secure and high-paid workers, separated from the ocean of private-sector American workers who must compete in today's dynamic economy."

According to the study:

* The federal government employs 1.9 million civilian workers.


* The average federal civilian worker earned $100,178 in wages and benefits in 2004, which compared to $51,876 for the average private-sector worker.


* Looking just at wages, federal workers earned an average $66,558 -- 56 percent more than the $42,635 earned by the average private worker.


* Since 1990 average federal compensation has increased 115 percent in the government -- compared to 69 percent in the private sector.

Cato's report argues that federal jobs should actually pay less, not more, than comparable private-sector jobs. Writes Edwards:

"Federal workers typically have generous holiday and vacation schedules, flexible work hours, training options, incentive awards, excessive disability benefits, flexible spending accounts, union protections and a usually more relaxed pace of work than private workers. Perhaps the most important benefit of federal work is the extreme job security. The rate of "involuntary separations" (layoffs and firings) in the federal workforce is just one-quarter the rate in the private sector. Just 1 in 5,000 federal non-defense workers is fired for poor performance each year.

"All these federal advantages in benefits suggest that, in comparable jobs, federal wages should be lower than private-sector wages."

Edwards suggests some ways to deal with the problem:

* Freeze federal wages for a period of years.


* Cut some fringe benefits.


* Don't fill vacated positions. There will be a vast surge in federal worker retirement as baby boomers enter their sixties. This offers a great opportunity to downsize federal agencies without problematic layoffs or buyouts.


* As the boomers retire in droves, privatize! Turn government functions over to the private sector whenever possible. "As government air traffic controllers, space scientists, and others retire in coming years, these activities should be handed over to the private sector so that they can be better managed and have more efficient compensation policies."

Great ideas. Now all that's needed are politicians with the wisdom, courage and integrity to call for such reforms.

The Greatest Persuasion Advantage You Can Ever Get

Want to easily win people to liberty? Want to give yourself an unfair advantage?

Marketing wizard Gary Halbert revealed the secret: find a crowd starving for freedom. Find people who have a burning desire for liberty. People with a gnawing hunger for small government.

But how do you find them?

There are several ways.

1. Simply describe your "starving crowd" to family, friends, and co-workers. Ask them: "Who do you know who thinks government is too big, too powerful, too bossy, and too costly?" "Who do you know who thinks taxes are too high and government's way too big?" Get the person's email address and drop him a note. Ask him, "Do you believe that government is too big, too bossy, and too costly?"

2. Hand out the World's Smallest Political Quiz. Use the "5 Lazy Ways You Can Advance Liberty in 3 Minutes" at the Advocates' Web site. People who score near the top of the Quiz chart are your crowd starving for liberty.

3. Find your "starving crowd" by using the simple and powerful networking scripts in Libertarian Bob Burg's terrific book Endless Referrals.

4. Advertise for your "starving crowd" at your personal or organization Web site. For example, "I'm looking for people who want to generously reduce taxes, roll back government spending, and make government smaller than it is today. If this describes you, contact me at: [your email address.]"

5. Give a "Lights of Liberty" speech [a libertarian-oriented speech to a service club, classroom or similar group]. Immediately after your speech, describe your "starving crowd" to the audience. Ask the audience, "If that describes you, would you raise your hand?" Ask them to give you their name, email address, and other contact info. Send them the Web link to the World's Smallest Political Quiz: http://www.theadvocates.org/quiz.html. Ask them to email you back with where they landed on the Quiz chart. It's a great appetizer for those starving for liberty.

Why is seeking out and finding a "starving crowd" so important?

"It's not particularly difficult to persuade people to do what they're already longing to do," wrote Aldous Huxley.

Because you won't have to sell liberty to them. They will eagerly buy it from you.

Because they won't demand perfection from you. Or hold you up to impossible standards of proof and evidence. Or insist that you be the world's most brilliant libertarian.

They want it bad. They have a burning desire for freedom.

They will persuade themselves. Enroll themselves.

A "starving crowd" is the greatest persuasion advantage you can ever get.

How absolute are my property rights in a libertarian system?

QUESTION: "How absolute are my property rights in a libertarian system? For example: I install a fish pond in my yard and stock it with trout. A corporation builds a coal-fired power plant 100 miles from my house. Because of their activity, traces of mercury show up in my fish. Do my property rights include the right not to have my land contaminated with poison?"

MY SHORT ANSWER: Yes. You always have recourse if a person harms your property. If someone dumps garbage on your lawn or mercury into your pond, you have the right to: 1) full restoration of your property; or 2) a settlement acceptable to you..

FOLLOW-UP QUESTION: "Suppose my next-door neighbor builds a stadium in his back yard and begins hosting noisy concerts at volumes that make it impossible for me to sleep at night. Is this a violation of my property rights?"

MY SHORT ANSWER: Most likely. The noise created by your neighbor is leaving his or her property and 'polluting' yours in a manner causing you physical harm.

"Nuisances in a libertarian society would often be dealt with through neighborhood covenants or condo-associations. For example, at the time of home construction, developers in a particular area might attach restrictions to the deeds of properties not included under condo agreements. These restrictions on noise and other nuisances would be looked upon favorably by buyers who wanted to be sure that their neighbors would act in a particular way. Violations of these covenants could result in prosecution or activation of an arbitration clause.

The advantage of such agreements is that you know in advance what levels of noise that your neighbors can have. Of course, if you have Vulcan-like hearing, your neighbor might not activate the nuisance clause by his or her noise and you might need to use ear plugs instead.

Without such pre-existing arrangements, resolution is obviously more difficult.

FOLLOW-UP QUESTION: "Suppose a nearby airport begins using the airspace over my house as part of its flight path. Do my property rights extend to the atmosphere?"

MY SHORT ANSWER: Your rights extend to your body and property. At this point in time, atmosphere per se hasn't been considered valuable, so property rights for it have not been well-defined.

However, if noise pollution causes you (or your livestock) significant harm, it may violate your property rights. Let's examine some possibilities.

If you move next to an existing airport, you do so knowing that noise from the airport is part of your household package. The airport has, in essence, already established its right to utilize the air space by 'homesteading' it. You would probably have recourse against the airport only if a new aircraft flying over your home caused new problems (e.g., windows breaking due to the type of noise, etc.).

If you live in a residential area, however, and a new airport opens, you have established your claim first. If the noise is mild, you might simply put up with it. If the noise keeps you from sleeping at night, you might ask the airport for compensation.

Today, most new airports are built outside of heavily populated areas so that anyone moving into the area will accept any noise -- and the lower price of homes -- as part of the package.
